ORDINANCE NO. 9958 AN ORDINANCE CLOSING AND ABANDONING PARKWOOD AVENUE, A 50-FOOT-WIDE RIGHT-OF-WAY, AND OLD PARKWOOD AVENUE, A 50-FOOT WIDE UNOPENED RIGHT OF WAY, LOCATED SOUTHEAST FROM GLENWOOD DRIVE, SOUTHWEST OF CITICO AVENUE, AND LATTIMORE STREET WEST, A 40-FOOT-WIDE UNOPENED RIGHT-0F-WAY LOCATED SOUTHWEST FROM CITICO AVENUE, NORTHWEST OF FISHER STREET, MORE PARTICULARLY DESCRIBED HEREIN, UPON CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby closed and abandoned Parkwood Avenue, a 50-foot-wide right-of-way, and Old Parkwood Avenue, a 50-foot-wide unopened right-of-way, located southeast from Glenwood Drive, southwest of Citico Avenue, and Lattimore Street West, a 40-foot-wide unopened right-of-way located southwest from Citico Avenue, northwest of Fisher Street, more particularly described herein, and as shown on plat attached hereto and made a part hereof by reference: Tax Map No. 146E-D-4; 146E-G-1, 1.1 and 9-12; 146E-H-1-8; and 146L-J-18.1 and 34. SECTION 2. BE IT FURTHER ORDAINED, That this closure and abandonment is made subject to the following conditions: 0C 1. The reservation for Jupiter Industries, Inc., d/b/a Chattanooga Gas Company, of an easement the width of the street for its gas main, lines and other distribution facilities located within the petitioned right-of-way, which must be maintained for the use and benefit of its customers. 2. The Tennessee-American Water Company requests reservation of an easement 20 feet in width for the purpose of operating and maintaining their facilities located within the right-of-way. 3. The City of Chattanooga has a sewer located within one of the rights-of-way and reserves an easement for the purpose of maintaining said sewer. 4. The Chattanooga Cable TV Company requests that an easement be maintained within the right-of-way for ingress and egress of lines that provide service to its customers. 5. The areas reserved for utility easements must be kept free and clear of all structures. 6. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage as provided by law.
